EterMail provides a time capsule messaging platform that allows users to create, schedule, and deliver messages to recipients at specified future dates. Our service includes:

  • Message creation with text, images, and video
  • AI-assisted writing tools
  • Scheduled delivery with reminders
  • Public and private sharing options
  • Permanent archival through EterWall

3. User Accounts

3.1 Account Creation

To use certain features, you must create an account. You agree to:

  • Provide accurate and complete information
  • Maintain the security of your account
  • Notify us immediately of any unauthorized use
  • Be responsible for all activities under your account

3.2 Account Eligibility

You must be at least 18 years old to use EterMail. By creating an account, you represent that you meet this requirement.

4. Message Rules and Content

4.1 Prohibited Content

You may not create or send messages that contain:

  • Illegal content or content promoting illegal activities
  • Harassment, threats, or hate speech
  • Explicit sexual content (except between consenting adults)
  • Malware, viruses, or harmful code
  • Spam or unsolicited commercial content
  • Infringement of intellectual property rights
  • Personal information of others without consent

4.2 Message Immutability

Once sealed, messages become immutable and cannot be modified or deleted. This is a core feature to ensure authenticity. Review carefully before sealing.

4.3 Content Ownership

You retain all rights to your content. By using EterMail, you grant us a license to store, process, and deliver your messages as necessary to provide the service.

5. Payment and Refunds

5.1 Pricing

Pricing for plans and services is available on our pricing page. Prices may change, but changes will not affect sealed messages.

5.2 Payment Processing

Payments are processed through Stripe. By making a purchase, you agree to Stripe's terms and conditions.

5.3 Refund Policy

As EterMail provides digital products and services that are delivered and utilized immediately, our refund policy is strictly limited:

  • Digital Products and Services: All sales of digital items are final. No refunds will be provided once the purchase is completed.
  • Sealed Messages: No refunds under any circumstances (messages are immutable and securely stored).
  • Unused Gift Cards: Refundable within 30 days of purchase only if explicitly unredeemed.
  • AI Points & Credits: Non-refundable once purchased or allocated to your account.

6. Service Availability and Limitations

6.1 Service Guarantee

While we strive for 99.9% uptime, we cannot guarantee uninterrupted service. We are not liable for delays or failures due to force majeure, technical failures, recipient issues, or third-party service failures.

6.2 Usage Limits

  • Draft storage: 20 messages per account
  • Image uploads: 9 per message, 10MB each
  • Video uploads: Plan-dependent (3-60 minutes)
  • Message length: 50,000 characters

7. AI Features

AI-generated content is provided "as-is." We do not guarantee accuracy or appropriateness. You are responsible for reviewing and approving all AI-enhanced content before sealing.

8. Delivery and Recipients

We make reasonable efforts to deliver messages to specified recipients. Recipients must verify their identity to access messages.

9. Privacy and Data

Your use of EterMail is also governed by our Privacy Policy. Please review it to understand our data practices.

10. Intellectual Property

EterMail, its logo, and all related marks are our trademarks. Platform content and functionality are our property, except user-generated content.

11. Termination

You may delete your account at any time. We may suspend or terminate your account for violations of these Terms, fraud, or abuse.

12. Disclaimers

THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.

13. Limitation of Liability

WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES.

14. Indemnification

You agree to indemnify EterMail from any claims arising from your use of the service or violation of these Terms.

15. Dispute Resolution

Disputes will be resolved through binding arbitration. You agree to resolve disputes on an individual basis and waive any right to participate in class actions.

16. Changes to Terms

We may modify these Terms at any time. Continued use of the service after changes constitutes acceptance of the new Terms.

17. Governing Law

These Terms are governed by applicable laws, without regard to conflict of law provisions.
